LUNNA LIST OF PERMISSIONS

Below is a list of permissions that LUNNA will require a user to authorize access to;

  • Contacts List: Lunna shall access your contact list for purposes of connecting you with those on the platform. This shall also enable a user contact a stall owner directly on the Jamii Soko marketplace.  
  • Location: Lunna will pick your device’s location when you allow location permissions to enable you access stalls near you when using the Jamii Soko marketplace. 
  • Calendar: Use your default calendar.
  • Camera: Use your camera to take pictures or videos.
  • Microphone: Record audio.
  • Storage: Get photos and other files on your phone.
  • Files and media: Use photos, media, and other files on your phone.

Introduction

This Privacy Policy describes the personal data Lunna collects, processes, uses and retains. It also tells you about your privacy rights and how the law protects you.

This statement should be read together with the Terms and Conditions of Use for other Lunna products and services. Where there is a conflict, this statement will prevail.

This statement applies to all customers, suppliers, agents, merchants, dealers using the Service.

We use your personal data to provide and improve the service. By using the service, you agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions


Interpretation

The words in which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in the plural.

Definitions

For the purposes of this Privacy Policy:
  • "Account" means a unique account created for You to access our Service or parts of our Service.
  • "Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Afristec. The Company is the Data Controller.
  • "Country" refers to Kenya
  • "Data Controller" , refers to the Company as the legal person which alone or jointly with others, determines the purposes and means of the processing of Personal Data.
  • "Device" means any device that can access the Service such as a computer, a cell phone or a digital tablet.

Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.
  • "Sale" means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's personal information to another business or a third party for monetary or other valuable consideration.
  • "Service" refers to the application.
  • "Service Provider" means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors.
  • "Usage Data" refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • "Application" refers to Lunna accessible from google play store.
  • "You" means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

Lunna must receive or collect some information to operate, provide, improve, understand, customize, support, and market our Services, including when you install, access, or use our Services.

The types of information we receive and collect depend on how you use our Services. We require certain information to deliver our Services and without this we will not be able to provide our Services to you. For example, you must provide your mobile phone number to create an account to use our Services.

Our Services have optional features which, if used by you, require us to collect additional information to provide such features. You will be notified of such collection, as appropriate. If you choose not to provide the information needed to use a feature, you will be unable to use the feature. For example, you cannot share your location with your contacts if you do not permit us to collect your location data from your device. Permissions can be managed through your Settings menu on your devices.

Personal Data

While using Our Service, we may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally, identifiable information may include, but is not limited to:
  • Email address
  • First name and last name
  • Username
  • Phone number
  • Country
  • Usage Data

Usage Information.

We collect information about your activity on Lunna including but not limited to:
  • Peeks and other content you post (including the date, application, and version of Lunna) and information about your broadcast activity (e.g., stories) including broadcasts you’ve created and when you created them, your lists, bookmarks, and communities you are a part of.
  • Your interactions with other users’ content, such as likes, shares, replies, if other users mention or tag you in content or if you mention or tag them, and broadcasts you’ve participated in.
  • How you interact with others on the platform, such as people you follow and people who follow you, and when you use the Chat & Mail Box, including the contents of the messages, the recipients, and date and time of messages.
  • If you communicate with us, such as through email, we will collect information about the communication and its content. We collect information on links you interact with across our services (including in our emails sent to you).
Information we automatically collect;

Device Information - When you install or use our service, or when you contact customer support via our app, we collect information on your device’s hardware model and operating system, the Lunna app version, browser information, and your internet connection IP address. Information You Provide.

Your Account Information. You must provide your mobile phone number and basic information (including a profile name of your choice) to create a Lunna account. If you don’t provide us with this information, you will not be able to create an account to use our Services. You can add other information to your account, such as a profile picture and "about" information.

Your Connections. You can use the contact upload feature and provide us, if permitted by applicable laws, with the phone numbers in your address book on a regular basis, including those of users of our Services and your other contacts. If any of your contacts aren’t yet using our Services, we’ll manage this information for you in a way that ensures those contacts cannot be identified by us.

Service Usage Data-This include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When You access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device You use, your mobile device unique ID, the IP address of Your mobile device, your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

Chat Messages, images and videos – We store your chat messages you send and receive on our servers, so that if you reinstall the app or change phone, the app will pick up your chat messages again. You can delete chat messages within the app, and they will be deleted from our servers.

Log Information. We may receive information when you view content on or otherwise interact with our products and services, even if you have not created an account or are signed out, such as: IP address; browser type and language; operating system; the referring webpage; access times; pages visited; location; your mobile carrier; device information (including device and application IDs); search terms and IDs (including those not submitted as queries); ads shown to you on Lunna, Lunna-generated identifiers; and identifiers associated with cookies. We also receive log information when you click on, view, or interact with links on our services, including when you install another application through Lunna.

Location Information. We collect and use precise location information from your device with your permission when you choose to use location-related features, like when you decide to share your location with your contacts or view locations nearby or locations others have shared with you. There are certain settings relating to location-related information which you can find in your device settings or the in-app settings, such as location sharing. Even if you do not use our location-related features, we use IP addresses and other information like phone number area codes to estimate your general location (e.g., city and country). We also use your location information for diagnostics and troubleshooting purposes.

Cookies- We use cookies to improve your experience with us when visiting our website, by remembering options such as a login session token and your preferred language. These cookies contain no personally identifiable information.

We also use Google Analytics to track user interaction. We use this data to determine the number of people using our website, to better understand how they find and use our web pages, and to see their journey through our website. Google Analytics records data such as your geographical location, device, internet browser and operating system, and your internet connection IP address. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website.

Your web browser allows you to delete cookies and disable them in the future. Should you delete or disable cookies, you may find that some of our services are unavailable to you.

How We Use Information

We shall use the information we have (subject to choices you make and the applicable law) to operate, provide, improve, understand, customize, support, and market our Services. We, however, shall not use your Personal Information and contact list for targeted advertisements. We may use the information as follows:

To provide and maintain our Services we use information we have to operate and provide our Services, including providing customer support; completing purchases or transactions; improving, fixing, and customizing our Services. We also use information we have to understand how people use our Services; evaluate and improve our Services; research, develop, and test new services and features; and conduct troubleshooting activities. We also use the information we have to communicate with you about our terms, policies, and other important updates. We also use your information to respond to you when you contact us.

Safety, Security, and Integrity. S Safety, security, and integrity are an integral part of our Services. We use information we have to verify accounts and activity; combat harmful conduct; protect users against bad experiences and spam; and promote safety, security, and integrity on and off our Services, such as by investigating suspicious activity or violations of our Terms and policies.

We also use the information collected to handle user reports. Just as you can report other users, other users or third parties may also choose to report to us your interactions and your messages with them or others on our Services; for example, to report possible violations of our Terms or policies. When a report is made, we collect information on both the reporting user and reported user to enable use make decisions.

Business Interactions. We enable you and third parties, like businesses, to communicate and interact with each other using our Services, such as Jamii Soko and Communities for businesses on Lunna through which you can browse products and services and place orders. Businesses may send you transactions, appointments, and shipping notifications; product and service updates; and marketing. For example, you may receive information for, a receipt for something you purchased, or a notification when a delivery will be made. Messages you receive from a business could include an offer for something that might interest you. We do not want you to have a spammy experience; as with all of your messages, you can manage these communications and choose to turn off such, and we will honor the choices you make.

For other connected purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

Information You and We share

You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.
  • Send your information to those with whom you choose to communicate. You share your information (including messages) as you use and communicate through our Services.
  • Information associated with your account. Your phone number, profile name and photo, "about" information, last seen information, and message receipts are available to anyone who uses our Services, although you can configure your Services settings to manage certain information available to other users, including businesses, with whom you communicate.
  • Your contacts and others. Users, including businesses, with whom you communicate can store or reshare your information (including your phone number or messages) with others on and off our Services. You can use your Services settings and the “block” feature in our Services to manage who you communicate with on our Services and certain information you share.
  • Businesses On WhatsApp. We offer specific services to businesses such as providing them with metrics regarding their use of our Services.
  • Third-Party Service Providers. We work with third-party service providers and other service providers to help us operate, provide, improve, understand, customize, support, and market our Services. We work with these companies to support our Services, such as to provide technical infrastructure, delivery and other systems; market our Services; conduct surveys and research for us; protect the safety, security, and integrity of users and others; and assist with customer service. When we share information with third-party service providers and other service providers in this capacity, we require them to use your information on our behalf in accordance with our instructions and terms.
  • Third-Party Services. When you or others use third-party services that are integrated with our Services, those third-party services may receive information about what you or others share with them. For example, if you use a data backup service integrated with our Services (like iCloud or Google Drive), they will receive information you share with them, such as your WhatsApp messages. If you interact with a third-party service linked through our Services, such as when you use the in-app player to play content from a third-party platform, information about you, like your IP address and the fact that you are a Lunna user, may be provided to such third party. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services and products.
  • When required by law, to prevent harm, or in the public interest. We may preserve, use, share, or disclose your information if we believe that it is reasonably necessary to:
    • comply with a law, regulation, legal process, or law enforcement request;
    • protect the safety of any person, protect the safety or integrity of our platform, including to help prevent spam, abuse, or malicious actors on our services;
    • explain why we have removed content or accounts from our services
    • (e.g., for a violation of Lunna Terms and Conditions);
    • address fraud, security, or technical issues; or
    • protect our rights or property, or the rights or property of those who use our services.
  • With Affiliates We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • As a result of a change in ownership. We may share, sell, or transfer information about you in connection with a merger, acquisition, reorganization, sale of assets, or bankruptcy. This Privacy Policy will apply to your personal information that is shared with (before and after the close of any transaction) or transferred to the new entity.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to and maintained on computers located outside of Your country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition, or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Law-enforcement agencies, regulatory authorities, courts, or other statutory authorities in response to a demand issued with the appropriate lawful mandate and where the form and scope of the demand is compliant with the law.

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service

The Service Providers We use may have access to Your Personal Data. These third-party vendors collect, store, use, process, and transfer information about Your activity on Our Service in accordance with their Privacy Policies.

Payments

We may provide paid products and/or services within the Service. In that case, we may use third-party services for payment processing (e.g. payment processors).

We will not store or collect Your payment card details. That information is provided directly to Our third-party payment processors whose use of Your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Exercising Your Data Protection Rights

You may exercise Your rights of access, rectification, cancellation, and opposition by contacting Us. Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, we will try our best to respond to You as soon as possible.

Children's Privacy

Our Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, we take steps to remove that information from Our servers.

Mobile Devices

Your mobile device may give You the ability to opt-out of the use of information about the apps You use in order to serve You with ads that are targeted to Your interests:

  • "Opt out of Interest-Based Ads" or "Opt out of Ads Personalization" on Android devices
  • "Limit Ad Tracking" on iOS devices

You can also stop the collection of location information from Your mobile device by changing the preferences on Your mobile device.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, you will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Retention of Information

We shall keep different types of information for different periods of time:
  • We keep your profile information and content for the duration of your account.
  • We generally keep other personally identifiable data we collect when you use our products and services for a maximum of 18 months.
  • Remember public content can exist elsewhere even after you remove it is from Lunna. For example, search engines and other third parties may retain copies of your posts longer, based upon their own privacy policies, even after they are deleted or expire on Lunna.
  • Where you violate our Rules and your account is suspended, we may keep the identifiers you used to create the account (i.e., email address or phone number) indefinitely to prevent repeat policy offenders from creating new accounts.
  • We may keep certain information longer than our policies specify in order to comply with legal requirements and for safety and security reasons.

Changes to this Privacy Policy

The most current version of this Privacy Policy governs our processing of your personal data and we may revise this Privacy Policy from time to time as needed. If we do revise this Privacy Policy and make changes that are determined by us to be material, we will provide you notice and an opportunity to review the revised Privacy Policy before you continue to use Lunna. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
